Artículo 1: Preámbulo

www.sweetinn.com es una página web dedicada al alquiler de apartamentos vacacionales y proporciona acceso a listados de inmuebles en alquiler a corto plazo. La página web ofrece la posibilidad de realizar reservas online.
Opera mediante la sociedad limitada SWEET INN LUXEMBOURG, con domicilio fiscal sito en 128 Boulevard de la Petrusse, Luxembourg (en adelante, SWEET INN).
Estos términos de uso (en adelante, TDU) se aplican a todos los términos de usa de la página web accesible mediante la URL www.sweetinn.com (en adelante, la Web).
Se acuerdan entre SWEET INN, de una parte, y el Usuario, por la otra parte, en adelante designados colectivamente como las"PARTES".
Importante: Cualquier uso que se le dé a la Web www.sweetinn.com implica, necesariamente, la aceptación incondicional de estos TDU por parte del Usuario.

Artículo 2: Definiciones

Los términos definidos más abajo establecen los siguientes significados para las Partes: - "Residente" indica cualquier usuario registrado en la Web que desee alquilar una propiedad disponible online.
- "Anuncio" indica cualquier material relativo a los listados de alquileres, incluidas fotografías, descripciones de la propiedad, precios y referencias contenidas en la descripción.
- "Alojamiento" indica cualquier propiedad disponible anunciada en la Web.
- "Miembro" indica cualquier usuario que se registre en la Web.
- "Web" indica la página web accesible en www.sweetinn.com. La Web comprende todas las páginas web alojadas en SWEET INN.
- "Usuario" indica cualquier persona que visite la web, incluidos los Arrendatarios.

Artículo 3: Acceso a la página web

El Usuario asegura disponer de las capacidades y medios necesarios para acceder y utilizar la Web y ha comprobado que la configuración que utiliza no contiene virus y que funciona perfectamente.
SWEET INN se esfuerza por ofrecerle a sus arrendatarios información o herramientas disponibles y verificadas, pero no se hace responsable de los errores, falta de disponibilidad de funciones o de la presencia de virus en su Web.
La Web está disponible las 24 horas del día. SWEET INN no se hace responsable de las discontinuidades de la Web y sus servicios, ya sean voluntarios o no. Asimismo, por motivos de mantenimiento, SWEET INN podrá interrumpir la Web e informará a sus usuarios

Artículo 4: Obligaciones de los usuarios

Cada Usuario se compromete a no alterar el orden público, a acatar las leyes y normativas y a respetas los derechos de terceras partes, así como las provisiones de estos TDU.
Cada Miembro está obligado a:
- Actuar con justicia en lo referente a SWEET INN y terceras partes colaboradoras.
- Proporcionarle a SWEET INN información honesta y sincera.
- Usar la Web según los objetivos establecidos en estos TDU.
- No usar la Web como medio para cometer delitos, faltas u ofensas menores que sean sancionables atendiendo al Código Penal o cualquier otra ley.
- No intentar desviar el tráfico hacia otra página web o servicio de la competencia.
- No intentar socavar la Sección 323_1 y el Código Penal relativos a los sistemas automáticos de procesamiento de datos implementados para el lanzamiento de la Web.
- No introducir hipervínculos en la Web.

Artículo 5: Protección de datos

Según la Ley de Protección de Datos 5741-1981 relacionada con los datos, los archivos y la libertad, informamos al Usuario de que el editor de la Web aplica un procesamiento de datos personales.
SWEET INN es responsable del procesamiento de los datos recogidos mediante la Web. Estos datos son procesados para garantizar el adecuado funcionamiento de la Web y garantizar que se cumplan las exigencias del Usuario. El tratamiento de los datos personales ha sido declarado ante la ILITA, atendiendo a la Ley de Protección de Datos 5741- 1981.
Los datos se recogen a medida que el Usuario navega por la Web (ej. dirección IP) o mediante los formularios de la Web. Estos datos son necesarios para procesar las solicitudes de los Usuarios. Los receptores de estos datos son las personas encargadas de gestionar el importante servicio de SWEET INN y la empresa encargada del hosting de la Web.
Los Usuarios tiene derecho a consultar, modificar y/o suprimir sus datos o oponerse al uso de éstos argumentando motivos legítimos. Todos los derechos se le comunican al Usuario mediante un email enviado por info@sweetinn.com con asunto «PROTECCIÓN DE DATOS», que incluye una copia del documento de la identidad del Usuario.

Artículo 6: Cookies

The User also has other options to reject and or/ delete the cookies
Thus, the User can configure their browser to accept or reject cookies, case by case, prior to their installation.
Furthermore, the User can also regularly delete cookies from their browser via its terminal.

SWEET INN also draws the User's attention to the fact that, when the User opposes the installation or use of a cookie, a cookie refusal is installed on their terminal equipment.
However, if the refusal cookie is deleted, it will not be possible to identify the User as having refused the use of cookies.
Right of opposition and access:
The User has the right to object by the means described above.

Artículo 7: Propiedad intelectual

Todo el contenido (marcas, logotipos, eslóganes, gráficos, fotografías, animaciones, vídeos y textos) recogidos en la Web, salvo los contenidos publicados por los Usuarios, son propiedad intelectual exclusiva de SWEET INN y no podrán ser reproducidos, utilizados o representados in consentimiento expreso previo de SWEET INN bajo pena de enjuiciamiento.
Está prohibida la representación total o parcial de la Web y sus contenidos, sea cual sea el medio, sin el consentimiento previo expreso de SWEET INN y constituye una infracción sancionable mediante los Artículos L 335-2 y L 713-1 y según dicta el Código de la Propiedad Intelectual.
Está prohibida la introducción de enlaces profundos en una página de la Web sin que exista consentimiento previo por escrito de SWEET INN- SWEET INN prohibe expresamente: la extracción, mediante transferencia permanente o temporal de cualquier parte cualitativa o cuantitativamente sustancial del contenido de una base de datos a otro medio mediante cualquier medio o forma, y la reutilización de cualquier parte cualitativa o cuantitativamente sustancial del contenido de una base de datos.

Artículo 8: Limitación de responsabilidad

SWEET INN rechaza toda responsabilidad:
- Si no se puede acceder temporalmente a la Web por motivo de mantenimiento técnico o actualización de la información publicada,
- En caso de que se produzcan ataques de virus informáticos,
- En caso de que la información del Usuario sea incorrecta o no esté completa,
- En caso de que se generen anuncios incorrectos,
- En las relaciones entre Usuarios,
- En caso de uso anormal o ilícito de la Web, el Usuario será responsable de cualquier daño a terceras partes y de las acciones o reclamaciones subsiguientes que pudieran surgir,
- En relación con los contenidos publicados por los Arrendatarios, SWEET INN tiene derecho preferente para moderar los comentarios que éstos dejan. Los Arrendatarios podrán hacer comentarios sobre la Web mediante un email enviado a SWEET INN transcurridas 48 horas desde el fin de su estancia en una propiedad SWEET INN.

En ningún caso será responsable SWEET INN de la falta de ejecución o la ejecución incorrecta de las obligaciones contractuales atribuibles al Usuario, en concreto, durante el intercambio de información entre Usuarios o cuando los Usuarios publican contenidos.
SWEET INN no será responsable ni se considerará que ha incumplido alguno de estos términos en caso de retraso o fallo cuando el motivo de retraso o falta de ejecución esté ligado a un caso de fuerza mayor, según queda definido en la jurisprudencia precedente y en los tribunales franceses.
SWEET INN no es responsable y, por tanto, no deberá reparar ningún daño resultante que puedan padecer los Usuarios o terceras partes como consecuencia del uso de la Web. En este caso, el término daño "indirecto" hace referencia a daños que no sean un resultado exclusivo y directo de las acciones de SWEET INN o la falta de ellas.

Artículo 9: Modificación de los TDU

En adelante, SWEET INN se reserva el derecho a modificar en cualquier momento los TDU arriba citados.
Los cambios se aplicarán 48 horas después de su publicación.
Los Usuarios podrán consultar los cambios en los TDU comprobando la fecha de actualización de los mismos.

Artículo 10: Validez de los TDU

El hecho de que una de las Partes no exija la aplicación de alguna de las provisiones de estos TDU, ya sea de forma permanente o temporal, no se interpretará de ningún modo como exención de dichas provisiones.
Si se declarara inválida alguna de las provisiones de estos TDU bajo una provisión legislativa o normativa vigente y/o mediante decisión judicial aplicada res judicata, se estimará que dicha provisión no existe, sin que esto afecte a la validez del resto de provisiones, que seguirán plenamente vigentes.
En ese caso, las Partes aceptan elaborar una provisión nueva que sustituya a la que ha sido declarada nula e irrelevante. Se considera que la nueva provisión deberá parecerse y ajustarse lo máximo posible al espíritu de la provisión a la que sustituye y al impacto económico de ésta sobre las Partes.

Artículo 11: Provisiones generales

El hecho de que una de las Partes no exija la aplicación de alguna de las provisiones de estos TDU, ya sea de forma permanente o temporal, no se interpretará de ningún modo como exención de dichas provisiones.
Estos TDU no aseguran ninguna garantía o exclusividad a los usuarios con respecto a la prestación de servicios.
Si se declarara inválida alguna de las provisiones de estos TDU bajo una provisión legislativa o normativa vigente y/o mediante decisión judicial aplicada res judicata, se estimará que dicha provisión no existe, sin que esto afecte a la validez del resto de provisiones, que seguirán plenamente vigentes.

Artículo 12: Ley aplicable y jurisdicción competente

ESTOS TÉRMINOS SE RIGEN POR LA LEGISLACIÓN FRANCESA. EN CASO DE LITIGIO, SOLO TENDRÁN COMPETENCIA LOS TRIBUNALES DE PARÍS.
Esto se aplica a las normas sustantivas y a las normas procesales, sin detrimento de las obligaciones sustanciales o adicionales de los lugares de ejecución.

www.sweetinn.com is a Website dedicated to the seasonal rental of apartments, and which provides access to listings of short-term real estate rentals. The Website provides the ability to make reservations online. It is operated by SWEET INN LUX Limited liability company, with registered office at 128 Boulevard de la Petrusse, Luxembourg (hereinafter SWEET INN). These Terms of Service (hereafter TOS) govern all terms of use of the Website accessible at URL www.sweetinn.com (hereinafter the Website). They are concluded between SWEET INN on the one hand and the User on the other, hereinafter collectively referred to as "PARTIES". The contract for the booking of an apartment in Bruxelles is concluded between SWEET INN BELGIQUE S.P.L.R and the User. Important: Any use in any capacity whatsoever of the Website www.sweetinn.com necessarily implies the unconditional acceptance by the User of these TOS.

Article 2: Definitions

The terms defined below give the parties the following meanings: - "Resident" refers to any user registered on the Website who wishes to rent properties available online. - "Listing" refers to all material concerning the rental listings, including photographs, descriptions of the property, prices and references under the description. - "Services" refers to all the paid additional services provided by Sweet inn on the online Website such as cleaning or an extra fee for additional visitors. - "Housing" refers to the available properties published on the online Website. - "Member" refers to any user who registers on the Website. - "Website" refers to the Website accessible at www.sweetinn.com. The Website amalgamates all online web pages hosted by SWEET INN. - "User" refers to any person who visits the Website, including Tenants.

Article 3: Create an account

Access to the Website is open to all online Users, as are the ads and the calendar, which displays apartment availability. However, for some Website features, Users need to be a Member in order to gain accessibility. For example, only Members may book online on the Website. As such, only individuals, be they under or over 18 years of age, may register to become a Member and/or justify an authorization from his legal representatives or any corporation acting through a natural person with legal capacity to contract in the name and on behalf of the legal person . The Member agrees not to create or use other accounts that were initially created, either under his own identity or that of a third party, without the prior written permission of the publisher. Otherwise if he did not get prior written permission, the account will be suspended, including all services associated with it. The Member is obligated to notify the publisher immediately of any compromise on the confidentiality of his password or any other third party use of which he has knowledge. Upon receiving this notification, the editor will delete the password within 48 hours, allowing access to the customer center. If the Member has selected to login using the integrated Facebook connection to the Website interface, SWEET INN has the right to use the data available from the Facebook account. Once the Member has provided their Facebook username and password, SWEET INN allows the Facebook login to connect automatically on subsequent logins to the Website. The data available on the Member’s Facebook account allows the User to register without having to complete a new online registration form. The personal information SWEET INN requires in order to perform a reservation is collected directly from the Facebook account, with the authorization of the Member. The Member has the right to access, modify, rectify and delete data concerning themselves, according to Israeli Protection of Privacy Law, 5741-1981.

Article 4: Member obligations

As part of the use of the Website, each Member undertakes not to undermine the public order and comply with laws and regulations, respect the rights of third parties and the provisions of these TOS. Each member is obliged to: - Act fairly towards SWEET INN and its third parties. - Provide honest and sincere information to SWEET INN. - Use the Website in accordance with the purposes stated in this TOS. - Not make use of the Website in order to commit crimes, misdemeanours or petty offenses that are punishable under the Penal Code or any other law. - Not attempt to divert traffic to another Website or a competitive service. - Not seek to undermine articles 504quater, 550bis or 550ter of the Penal Code to automate data processing systems implemented for the launch of the Website. - Not insert hyperlinks into the Website.

Article 5: SWEET INN Obligations

The publisher strives to offer Tenants information or tools available, which are correct and verified. However SWEET INN will not be held responsible for any errors, lack of availability of features or the presence of viruses on its Website. The Website is accessible 24 hours a day and 7 days a week. The editor of the Website will not, however, be held responsible for any discontinuances and interruptions of the Website and its services, whether voluntary or not. In addition, the publisher of the Website may interrupt its activity for maintenance reasons and will endeavour to inform Users of this interruption. SWEET INN disclaims all responsibility: • If it is unable to temporarily access the Website for technical maintenance or to update the published information, • In the event of computer virus attacks, • In the event of incomplete or incorrect User information, • In the event of incorrect advertisements, • In relations between Users, • In the event of abnormal use or illicit exploitation of the Website, the User will be held responsible for any damage to third parties and for the consequent actions or claims that may arise. SWEET INN will not, under any circumstances, be held liable for nonperformance or improper performance of contractual obligations attributable to the User, in particular during the exchange of information between Users or when publishing content by Users. SWEET INN will not be held liable or deemed to have breached these terms in the event of any delay or failure when the cause of delay or nonperformance is linked to a case of force majeure as defined by Belgian law. SWEET INN is not responsible and thus does not repair any consequential damages suffered by Users or any third party due to the use of the Website. Here, the term "indirect" damage refers to damages that are not exclusively and directly the result of a SWEET INN actions or lack thereof.

Article 6: Reservation conditions

The total price paid by a SWEET INN Tenant includes the price of the apartment rental and the Services (such as cleaning or an extra fee for additional visitors, etc.). The fees, charges and deposit are all detailled in the Listings. These amounts correspond to the prices in effect when the contract is agreed upon. The delivery time of the Services can be from one to three days, prior to booking, according to the Service chosen. The average security deposit is three hundred Euros. It will be requested upon check in, and refunded after check out if no damages are found in the apartement, as described at article 7 of present TOS. After the Tenant selects the apartment and the extra Services, he will complete the reservation process by paying with credit card or via the Paypal secure payment module directly on the Website. The prices are in euros and the commission on extras proposed by SWEET INN varies according to the proposed Services. SWEET INN offers the secure payment system PAYPAL. The cost of credit card payment is entirely the responsibility of the Member. The proposed method of payment is SSL secured payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the internet. It is available on almost all Internet browsers (Internet Explorer, Microsoft, Navigator V1.1, Netscape, Firefox etc.). The information Members provide of their credit or debit cards (number, expiration date of validity, etc.) is encrypted before the sending of the e-mail to the transactions payment server. Article 7 : Witheld of Security Deposit

The security deposit is subjected to be withheld for the following reasons : - Damaged or broken furniture - Damaged kitchen applicances or lighting - Damaged television of Hi-Fi equipment - Stained or damaed walls and upholstery - Broken dishes, windows or mirrors - Damaged or missing accesories - Flooding or fire In addition, and with reference to the legal dispositions of the article 561of the Penal code, any noise poluttion occuring between 10 pm and 6 am is considered as a breach of distrubance of the peace at night, punished by a maximum amend of 20 euros and 5 days of imprisonement. As such, your deposit can be withheld. In order to avoid any conflicts, SWEET INN recommand if something gets damaged during your stay, to contact your Guest Relations.

Article 8: Online Comments

Only members who have stayed in the precise locations may evaluate the accommodations. Each Tenant will receive an email message within 48 hours after checkout reminding them to comment and assess the precise housing in which they stayed. SWEET INN has a pre-moderation power over the comments left by Members. Comments must, in any event, not conflict with any laws and regulations, morality and public order, nor denigrate disproportionately the accommodations displayed on the Website. SWEET INN has also provided tools that enable members to share the advertisements across different community Websites, social networks and blogs published by third parties. SWEET INN exclusively allows the User to share this type of communication for promotional purposes, excluding any commercial use or promotions unrelated to SWEET INN projects.

Article 9: Waiver of right of withdrawal

According to the articles XIV.29 and XIV.35 of the Code of Economic law, the right of withdrawal does not include: 1. Contracts for the supply of services if performance has begun, with the consumer's agreement, before the end of the withdrawal period. 2. Hosting services other than residential accommodation, goods transport services, car rental, catering or leisure activities to be provided on a date or at a specific period. The Member may not therefore claim any refund of service fees from SWEET INN.

Article 10: Penalty measures

In case of violation of these TOS, SWEET INN reserves the right to take the following measures with the Member concerned: - Suspend the Member's account during all the initiated procedures. - Delete the Member's account at the end of the procedure. Members whom the above sanctions and/or restrictions and/or suspensions on the Website apply to, may not open a new account on the Website.

Article 11: Data protection

According to the Israeli Protection of Privacy Law, 5741-1981, the User is informed that the Website editor implements a processing of personal data. SWEET INN is responsible for processing the data collected on the Website. This data is processed to ensure the proper functioning of the Website and to ensure Users demands are met. The treatment of personal data is in accordance with the Israeli Protection of Privacy Law, 5741-1981. The data is collected via a User browsing the Website (eg IP address) or collected via collection forms on the Website. This data is necessary in order to process requests from users. The recipients of the data are those who deal with the relevant SWEET INN service and the host of the Website. Each User has the right to query, modify and/or delete the data concerning themselves or claim opposition for legitimate reasons to the use of their data. All of these rights are provided in the email sent by info@sweetinn.com indicated by the subject line « DATA PROTECTION », which encloses a copy of the Member’s identity document.

Article 13: Intellectual Property

Except for content posted by Users, the brands, logos, slogans, graphics, photographs, animations, videos and texts found on the Website are the exclusive intellectual property of SWEET INN and may not be reproduced, used or represented without the prior express consent of SWEET INN under penalty of prosecution. Total or partial representation of the Website and its contents, by any means whatsoever, without the prior express consent of SWEET INN is prohibited and constitutes an infringement punishable by articles 504quater and 550bis of the Penal Code and following of the Code of Economic law (especially titles 6 and 7 of Book XI). The insertion of deep links to a page on the Website is prohibited without the prior written consent of SWEET INN. SWEET INN expressly forbids: the extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the contents of a database to another medium by any means and in any form whatsoever, and the reuse of all or a qualitatively or quantitatively substantial part of the database content.

Article 14: Enforceability of TOS

These TOS are binding upon registration of a Member on the Website. These TOS are binding throughout the operating life of the Website, and until new TOS replace the present.

Article 15: Modification of TOS

SWEET INN hereafter reserves the right to change the above TOS at any time. The changes will take effect 48 hours after publication. Users will be informed of TOS changes by consulting the date of last update of the TOS.

Article 16: Validity of TOS

The fact that one of the Parties did not require the application of any provision of these TOS, whether permanently or temporarily, shall under no circumstances be regarded as a waiver of such provisions. www.sweetinn.com is a Website dedicated to the seasonal rental of apartments, and which provides access to listings of short-term real estate rentals. The Website provides the ability to make reservations online. It is operated by SWEET INN LUXEMBOURG Limited liability company, with registered office at 128 Boulevard de la Petrusse, Luxembourg (hereinafter SWEET INN). These Terms of Service (hereafter TOS) govern all terms of use of the Website accessible at URL www.sweetinn.com (hereinafter the Website). They are concluded between SWEET INN on the one hand and the User on the other, hereinafter collectively referred to as "PARTIES". The contract for the booking of an apartment in Barcelona is concluded between SWEET INN ACCOMODATION INN SPAIN and the User. Article 2: Definitions

The terms defined below give the parties the following meanings: - "Resident" refers to any user registered on the Website who wishes to rent properties available online. - "Listing" refers to all material concerning the rental listings, including photographs, descriptions of the property, prices and references under the description. - « Services» refers to all the paid additional services provided by Sweet inn on the online Website such as cleaning or an extra fee for additional visitors. - "Housing" refers to the available properties published on the online Website. - "Member" refers to any user who registers on the Website. - "Website" refers to the Website accessible at www.sweetinn.com. The Website amalgamates all online web pages hosted by SWEET INN. - "User" refers to any person who visits the Website, including Tenants.

Article 3: Create an account

Access to the Website is open to all online Users, as are the ads and the calendar, which displays apartment availability. However, for some Website features, Users need be a Member in order to gain accessibility. For example, only Members may book online on the Website. As such, only individuals, be they under or over 18 years of age, may register to become a Member and/or justify an authorization from his legal representatives or any corporation acting through a natural person with legal capacity to contract in the name and on behalf of the legal person . The Member agrees not to create or use other accounts that were initially created, either under his own identity or that of a third party, without the prior written permission of the publisher. Otherwise if he did not get prior written permission, the account will be suspended, including all services associated with it. The Member is obligated to notify the publisher immediately of any compromise on the confidentiality of his password or any other third party use of which he has knowledge. Upon receiving this notification, the editor will delete the password within 48 hours, allowing access to the customer center. If the Member has selected to login using the integrated Facebook connection to the Website interface, SWEET INN has the right to use the data available from the Facebook account. Once the Member has provided their Facebook username and password, SWEET INN allows the Facebook login to connect automatically on subsequent logins to the Website. The data available on the Member’s Facebook account allows the User to register without having to complete a new online registration form. Article 4: Member obligations

As part of the use of the Website, each Member undertakes not to undermine the public order and comply with laws and regulations, respect the rights of third parties and the provisions of these TOS. Each member is obliged to: - Act fairly towards SWEET INN and its third parties. - Provide honest and sincere information to SWEET INN. - Use the Website in accordance with the purposes stated in this TOS. - Not make use of the Website in order to commit crimes, misdemeanours or petty offenses that are punishable under the Penal Code or any other law. - Not attempt to divert traffic to another Website or a competitive service. - Not seek to undermine articles 264 and following of the Penal Code to automate data processing systems implemented for the launch of the Website. - Not insert hyperlinks into the Website.

Article 5: SWEET INN Obligations

The publisher strives to offer Tenants information or tools available, which are correct and verified. However SWEET INN will not be held responsible for any errors, lack of availability of features or the presence of viruses on its Website. The Website is accessible 24 hours a day and 7 days a week. The editor of the Website will not, however, be held responsible for any discontinuances and interruptions of the Website and its services, whether voluntary or not. In addition, the publisher of the Website may interrupt its activity for maintenance reasons and will endeavour to inform Users of this interruption. Article 6: Reservation conditions

The total price paid by a SWEET INN Tenant includes the price of the apartment rental and the Services (such as cleaning or an extra fee for additional visitors, etc.). The fees, charges and deposit are all detailled in the Listings. These amounts correspond to the prices in effect when the contract is agreed upon. The delivery time of the Services can be from one to three days, prior to booking, according to the Service chosen. The average security deposit is three hundred Euros. It will be requested upon check in, and refunded after check out if no damages are found in the apartement, as described at article 7 of present TOS. After the Tenant selects the apartment and the extra Services, he will complete the reservation process by paying with credit card or via the Paypal secure payment module directly on the Website. The prices are in euros and the commission on extras proposed by SWEET INN varies according to the proposed Services. SWEET INN offers the secure payment system PAYPAL. The cost of credit card payment is entirely the responsibility of the Member. The proposed method of payment is SSL secured payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the internet. It is available on almost all Internet browsers (Internet Explorer, Microsoft, Navigator V1.1, Netscape, Firefox etc.). The information Members provide of their credit or debit cards (number, expiration date of validity, etc.) is encrypted before the sending of the e-mail to the transactions payment server. Article 7 : Witheld of Security Deposit

The security deposit is subjected to be withheld for the following reasons : - Damaged or broken furniture - Damaged kitchen applicances or lighting - Damaged television of Hi-Fi equipment - Stained or damaed walls and upholstery - Broken dishes, windows or mirrors - Damaged or missing accesories - Flooding or fire In addition, and with reference to the legal dispositions of the article 325 of the Penal code, an excessive noise poluttion can be considered as a criminal offense, punished by an amend between 6 month and 2 years of imprisonement and a fine between 10 and 14 months. As such, your deposit can be witheld. In order to avoid any conflicts, SWEET INN recommand if something gets damaged during your stay, to contact your Guest Relations.

Article 8: Online Comments

Only members who have stayed in the precise locations may evaluate the accommodations. Each Tenant will receive an email message within 48 hours after checkout reminding them to comment and assess the precise housing in which they stayed. SWEET INN has a pre-moderation power over the comments left by Members. Comments must, in any event, not conflict with any laws and regulations, morality and public order, nor denigrate disproportionately the accommodations displayed on the Website. SWEET INN has also provided tools that enable members to share the advertisements across different community Websites, social networks and blogs published by third parties. SWEET INN exclusively allows the User to share this type of communication for promotional purposes, excluding any commercial use or promotions unrelated to SWEET INN projects.

Article 9: Waiver of right of withdrawal

According to the law 3/2014 of March 27th, the right of withdrawal does not include: 1. Contracts for the supply of services if performance has begun, with the consumer's agreement, before the end of the withdrawal period (Article 103 a) of the law 3/2014 of March 27 th). 2. Hosting services other than residential accommodation, goods transport services, car rental, catering or leisure activities to be provided on a date or at a specific period (Article 103 j) of the law 3/2014 of March 27 th). The Member may not therefore claim any refund of service fees from SWEET INN.

Article 10: Penalty measures

In case of violation of these TOS, SWEET INN reserves the right to take the following measures with the Member concerned: - Suspend the Member's account during all the initiated procedures. - Delete the Member's account at the end of the procedure. Members whom the above sanctions and/or restrictions and/or suspensions on the Website apply to, may not open a new account on the Website.

Article 11: Data protection

According to the Israeli Protection of Privacy Law, 5741-1981, the User is informed that the Website editor implements a processing of personal data. SWEET INN is responsible for processing the data collected on the Website. This data is processed to ensure the proper functioning of the Website and to ensure user demands are met. The terms defined below give the parties the following meanings: - "Resident" any user registered on the Website who wishes to rent properties available online. - "Listing" refers to all material concerning the rental listings, including photographs, descriptions of the property, prices and references under the description. - « Services» refers to all the paid additional services provided by Sweet inn on the online Website such as cleaning or an extra fee for additional visitors. - "Housing" refers to the available properties published on the online Website. - "Member" refers to any user who registers on the Website. - "Website" refers to the Website accessible at www.sweetinn.com. The Website amalgamates all online web pages hosted by SWEET INN. - "User" means any person who visits the Website, including Tenants.

Article 3: Create an account

Access to the Website is open to all online Users, as are the ads and the calendar, which displays apartment availability. However, for some Website features, Users need be a Member in order to gain accessibility. For example, only Members may book online on the Website. As such, only individuals, be they under or over 18 years of age, may register to become a Member and/or justify an authorization from his legal representatives or any corporation acting through a natural person with legal capacity to contract in the name and on behalf of the legal person. The Member agrees not to create or use other accounts that were initially created, either under his own identity or that of a third party, without the prior written permission of the publisher. Otherwise if he did not get prior written permission, the account will be suspended, including all services associated with it. The Member is obligated to notify the publisher immediately of any compromise on the confidentiality of his password or any other third party use of which he has knowledge. Upon receiving this notification, the editor will delete the password within 48 hours, allowing access to the customer center. Article 4: Member obligations

As part of the use of the Website, each Member undertakes not to undermine the public order and comply with laws and regulations, respect the rights of third parties and the provisions of these TOS. Each member is obliged to: - Act fairly towards SWEET INN and its third parties. - Provide honest and sincere information to SWEET INN. - Use the Website in accordance with the purposes stated in this TOS. - Not make use of the Website in order to commit crimes, misdemeanours or petty offenses that are punishable under the Penal Code or any other law. - Not attempt to divert traffic to another Website or a competitive service. - Not seek to undermine articles 3 and following of the law 109/2009 of the 15 th of september 2009 to automate data processing systems implemented for the launch of the Website. - Not insert hyperlinks into the Website.

The publisher strives to offer Tenants information or tools available, which are correct and verified. However SWEET INN will not be held responsible for any errors, lack of availability of features or the presence of viruses on its Website. The Website is accessible 24 hours a day and 7 days a week. The editor of the Website will not, however, be held responsible for any discontinuances and interruptions of the Website and its services, whether voluntary or not. In addition, the publisher of the Website may interrupt its activity for maintenance reasons and will endeavour to inform Users of this interruption. Article 6: Reservation conditions

The total price paid by a SWEET INN Tenant includes the price of the apartment rental and the Services (such as cleaning or an extra fee for additional visitors, etc.). The fees, charges and deposit are all detailled in the Listings. These amounts correspond to the prices in effect when the contract is agreed upon. The delivery time of the Services can be from one to three days, prior to booking, according to the Service chosen. The average security deposit is three hundred Euros. It will be requested upon check in, and refunded after check out if no damages are found in the apartement, as described at article 7 of present TOS. After the Tenant selects the apartment and the extra Services, he will complete the reservation process by paying with credit card or via the Paypal secure payment module directly on the Website. The prices are in euros and the commission on extras proposed by SWEET INN varies according to the proposed Services. SWEET INN offers the secure payment system PAYPAL. The cost of credit card payment is entirely the responsibility of the Member. The proposed method of payment is SSL secured payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the internet. It is available on almost all Internet browsers (Internet Explorer, Microsoft, Navigator V1.1, Netscape, Firefox etc.). The information Members provide of their credit or debit cards (number, expiration date of validity, etc.) is encrypted before the sending of the e-mail to the transactions payment server. Article 7 : Witheld of Security Deposit

The security deposit is subjected to be withheld for the following reasons : - Damaged or broken furniture - Damaged kitchen applicances or lighting - Damaged television of Hi-Fi equipment - Stained or damaed walls and upholstery - Broken dishes, windows or mirrors - Damaged or missing accesories - Flooding or fire In addition, and with reference to the legal dispositions of the decree law n°9/2007, any noise poluttion occuring between 10 pm and 7 am can be considered as a criminal offense, punished by a fine between 200 euros and 2000 euros. As such, your deposit is also subject to be witheld. In order to avoid any conflicts, SWEET INN recommand if something gets damaged during your stay, to contact your Guest Relations.

Article 8: Online Comments

Only members who have stayed in the precise locations may evaluate the accommodations. Each Tenant will receive an email message within 48 hours after checkout reminding them to comment and assess the precise housing in which they stayed. SWEET INN has a pre-moderation power over the comments left by Members. Comments must, in any event, not conflict with any laws and regulations, morality and public order, nor denigrate disproportionately the accommodations displayed on the Website. SWEET INN has also provided tools that enable members to share the advertisements across different community Websites, social networks and blogs published by third parties. SWEET INN exclusively allows the User to share this type of communication for promotional purposes, excluding any commercial use or promotions unrelated to SWEET INN projects.

Article 9: Waiver of right of withdrawal

According to the decree-law nº 24/2014 of february 14 th 2014, the right of withdrawal does not include: 1. Contracts for the supply of services if performance has begun, with the consumer's agreement, before the end of the withdrawal period (Article 17 a) i), decree-law n°24/2014 of february 14th 2014 2. Hosting services other than residential accommodation, goods transport services, car rental, catering or leisure activities to be provided on a date or at a specific period (Article 17 j), decree-law n°24/2014 of february 14th 2014.). The Member may not therefore claim any refund of service fees from SWEET INN LISBON.

Article 10: Penalty measures

In case of violation of these TOS, SWEET INN reserves the right to take the following measures with the Member concerned: - Suspend the Member's account during all the initiated procedures. - Delete the Member's account at the end of the procedure. Members whom the above sanctions and/or restrictions and/or suspensions on the Website apply to, may not open a new account on the Website.

Article 11: Data protection

According to the Israeli Protection of Privacy Law, 5741-1981, the User is informed that the Website editor implements a processing of personal data. SWEET INN is responsible for processing the data collected on the Website. This data is processed to ensure the proper functioning of the Website and to ensure user demands are met. SWEET INN exclusively allows the User to share this type of communication for promotional purposes, excluding any commercial use or promotions unrelated to SWEET INN projects.

Article 9: Waiver of right of withdrawal

According to the law of the 17th of March 2014 the right of withdrawal does not include: 1. Contracts for the supply of services if performance has begun, with the consumer's agreement, before the end of the withdrawal period (Article L. 121-21-8 alinea 1 of the Consumer Code). 2. Hosting services other than residential accommodation, goods transport services, car rental, catering or leisure activities to be provided on a date or at a specific period ((Article L. 121-21-8 alinea 12 of the Consumer Code). The Member may not therefore claim any refund of service fees from SWEET INN.

Article 10: Penalty measures

In case of violation of these TOS, SWEET INN reserves the right to take the following measures with the Member concerned: - Suspend the Member's account during all the initiated procedures. - Delete the Member's account at the end of the procedure. Members whom the above sanctions and/or restrictions and/or suspensions on the Website apply to, may not open a new account on the Website.

Article 11: Data protection

According to the Israeli Protection of Privacy Law, 5741-1981, the User is informed that the Website editor implements a processing of personal data. SWEET INN is responsible for processing the data collected on the Website. This data is processed to ensure the proper functioning of the Website and to ensure user demands are met. The terms defined below give the parties the following meanings: - "Resident" refers to any user registered on the Website who wishes to rent properties available online. - "Listing" refers to all material concerning the rental listings, including photographs, descriptions of the property, prices and references under the description. - « Services» refers to all the paid additional services provided by Sweet inn on the online Website such as cleaning or an extra fee for additional visitors. - "Housing" refers to the available properties published on the online Website. - "Member" refers to any user who registers on the Website. - "Website" refers to the Website accessible at www.sweetinn.com. The Website amalgamates all online web pages hosted by SWEET INN. - "User" refers to any person who visits the Website, including Tenants.

Article 3: Create an account

Access to the Website is open to all online Users, as are the ads and the calendar, which displays apartment availability. However, for some Website features, Users need to be a Member in order to gain accessibility. For example, only Members may book online on the Website. As such, only individuals, be they under or over 18 years of age, may register to become a Member and/or justify an authorization from his legal representatives or any corporation acting through a natural person with legal capacity to contract in the name and on behalf of the legal person . The Member agrees not to create or use other accounts that were initially created, either under his own identity or that of a third party, without the prior written permission of the publisher. Otherwise if he did not get prior written permission, the account will be suspended, including all services associated with it. The Member is obligated to notify the publisher immediately of any compromise on the confidentiality of his password or any other third party use of which he has knowledge. Upon receiving this notification, the editor will delete the password within 48 hours, allowing access to the customer center. If the Member has selected to login using the integrated Facebook connection to the Website interface, SWEET INN has the right to use the data available from the Facebook account. The data available on the Member’s Facebook account allows the User to register without having to complete a new online registration form. The personal information SWEET INN requires in order to perform a reservation is collected directly from the Facebook account, with the authorization of the Member. Article 4: Member obligations

As part of the use of the Website, each Member undertakes not to undermine the public order and comply with laws and regulations, respect the rights of third parties and the provisions of these TOS. Each member is obliged to: - Act fairly towards SWEET INN and its third parties. - Provide honest and sincere information to SWEET INN. - Use the Website in accordance with the purposes stated in this TOS. - Not make use of the Website in order to commit crimes, misdemeanours or petty offenses that are punishable under the Penal Code or any other law. - Not attempt to divert traffic to another Website or a competitive service. - Not seek to undermine article 53 of the n°81 legal decree of 9th april 2008 to automate data processing systems implemented for the launch of the Website. - Not insert hyperlinks into the Website.

Article 5: SWEET INN Obligations

The publisher strives to offer Tenants information or tools available, which are correct and verified. However SWEET INN will not be held responsible for any errors, lack of availability of features or the presence of viruses on its Website. The Website is accessible 24 hours a day and 7 days a week. The editor of the Website will not, however, be held responsible for any discontinuances and interruptions of the Website and its services, whether voluntary or not. In addition, the publisher of the Website may interrupt its activity for maintenance reasons and will endeavour to inform Users of this interruption. Article 6: Reservation conditions

The total price paid by a SWEET INN Tenant includes the price of the apartment rental and the Services (such as cleaning or an extra fee for additional visitors, etc.). The fees, charges and deposit are all detailled in the Listings. These amounts correspond to the prices in effect when the contract is agreed upon. The delivery time of the Services can be from one to three days, prior to booking, according to the Service chosen. The average security deposit is three hundred Euros. It will be requested upon check in, and refunded after check out if no damages are found in the apartement, as described at article 7 of present TOS. After the Tenant selects the apartment and the extra Services, he will complete the reservation process by paying with credit card or via the Paypal secure payment module directly on the Website. The prices are in euros and the commission on extras proposed by SWEET INN varies according to the proposed Services. SWEET INN offers the secure payment system PAYPAL. The cost of credit card payment is entirely the responsibility of the Member. The proposed method of payment is SSL secured payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the internet. It is available on almost all Internet browsers (Internet Explorer, Microsoft, Navigator V1.1, Netscape, Firefox etc.). The information Members provide of their credit or debit cards (number, expiration date of validity, etc.) is encrypted before the sending of the e-mail to the transactions payment server. Article 7 : Witheld of Security Deposit

The security deposit is subjected to be withheld for the following reasons : - Damaged or broken furniture - Damaged kitchen applicances or lighting - Damaged television of Hi-Fi equipment - Stained or damaed walls and upholstery - Broken dishes, windows or mirrors - Damaged or missing accesories - Flooding or fire In addition, and with reference to the legal dispositions of the article 659 of the Penal code, any noise poluttion occuring between 10 pm and 7 am is considered as a breach of distrubance of the peace at night, punished by a maximum amend of 309 euros and 3 month of imprisonement. As such, your deposit can be witheld. In order to avoid any conflicts, SWEET INN recommand if something gets damaged during your stay, to contact your Guest Relations.

Article 8: Online Comments

Only members who have stayed in the precise locations may evaluate the accommodations. Each Tenant will receive an email message within 48 hours after checkout reminding them to comment and assess the precise housing in which they stayed. SWEET INN has a pre-moderation power over the comments left by Members. Comments must, in any event, not conflict with any laws and regulations, morality and public order, nor denigrate disproportionately the accommodations displayed on the Website. SWEET INN has also provided tools that enable members to share the advertisements across different community Websites, social networks and blogs published by third parties. SWEET INN will not be held liable or deemed to have breached these terms in the event of any delay or failure when the cause of delay or nonperformance is linked to a case of force majeure as defined by Israeli law. SWEET INN is not responsible and thus does not repair any consequential damages suffered by Users or any third party due to the use of the Website. Here, the term "indirect" damage refers to damages that are not exclusively and directly the result of a SWEET INN actions or lack thereof.

Article 6: Reservation conditions

The total price paid by a SWEET INN Tenant includes the price of the apartment rental and the Services (such as cleaning or an extra fee for additional visitors, etc.). The fees, charges and deposit are all detailled in the Listings. These amounts correspond to the prices in effect when the contract is agreed upon. The delivery time of the Services can be from one to three days, prior to booking, according to the Service chosen. The average security deposit is three hundred Euros. It will be requested upon check in, and refunded after check out if no damages are found in the apartement, as described at article 7 of present TOS. After the Tenant selects the apartment and the extra Services, he will complete the reservation process by paying with credit card or via the Paypal secure payment module directly on the Website. The prices are in euros and the commission on extras proposed by SWEET INN varies according to the proposed Services. SWEET INN offers the secure payment system PAYPAL. The cost of credit card payment is entirely the responsibility of the Member. The proposed method of payment is SSL secured payment. This payment protocol is standard and recognized worldwide for the protection of data transmitted over the internet. It is available on almost all Internet browsers (Internet Explorer, Microsoft, Navigator V1.1, Netscape, Firefox etc.). The information Members provide of their credit or debit cards (number, expiration date of validity, etc.) is encrypted before the sending of the e-mail to the transactions payment server. Article 7 : Witheld of Security Deposit

The security deposit is subjected to be withheld for the following reasons : - Damaged or broken furniture - Damaged kitchen applicances or lighting - Damaged television of Hi-Fi equipment - Stained or damaed walls and upholstery - Broken dishes, windows or mirrors - Damaged or missing accesories - Flooding or fire In addition, and with reference to the legal disposition (…). As such, your deposit is also subject to be witheld. In order to avoid any conflicts, SWEET INN recommand if something gets damaged during your stay, to contact your Guest Relations.

Article 8: Online Comments

Only members who have stayed in the precise locations may evaluate the accommodations. Each Tenant will receive an email message within 48 hours after checkout reminding them to comment and assess the precise housing in which they stayed. SWEET INN has a pre-moderation power over the comments left by Members. Comments must, in any event, not conflict with any laws and regulations, morality and public order, nor denigrate disproportionately the accommodations displayed on the Website. SWEET INN has also provided tools that enable members to share the advertisements across different community Websites, social networks and blogs published by third parties. SWEET INN exclusively allows the User to share this type of communication for promotional purposes, excluding any commercial use or promotions unrelated to SWEET INN projects.

Article 9: Waiver of right of withdrawal

According to the Consumer Protection Law 5741-1981 and the Regulation No. 2(3) to the Consumer Protection Regulations (cancelling of a transaction), 5771-2010, the Consumer may cancel the reservation and/or the service within 14 days from the reservation's date, provided that the date the service is due to commence is not less than 7 days from the day of reservation.

Article 10: Penalty measures

In case of violation of these TOS, SWEET INN reserves the right to take the following measures with the Member concerned: - Suspend the Member's account during all the initiated procedures. - Delete the Member's account at the end of the procedure. Members whom the above sanctions and/or restrictions and/or suspensions on the Website apply to, may not open a new account on the Website.

Article 11: Data protection

According to the Protection of Privacy Law,5741-1981, the User is informed that the Website editor implements a processing of personal data. SWEET INN is responsible for processing the data collected on the Website. This data is processed to ensure the proper functioning of the Website and to ensure User demands are met. The treatment of personal data is according to the Protection of Privacy Law, 5741-1981. The data is collected via a User browsing the Website (eg IP address) or collected via collection forms on the Website. This data is necessary in order to process requests from users. The recipients of the data are those who deal with the relevant SWEET INN service and the host of the Website. Each User has the right to query, modify and/or delete the data concerning themselves or claim opposition for legitimate reasons to the use of their data. All of these rights are provided in the email sent by info@sweetinn.com indicated by the subject line « DATA PROTECTION », which encloses a copy of the Member’s identity document.

Article 12: Cookies

When accessing the extranet, cookies or witness cookies may be installed in the User terminal.
Cookies are data stored in the terminal equipment of a surfer and used by the Website to send information to the browser of the Internet, and allowing the browser to send information to the original site (for example an identifier session, the choice of language or date).
Cookies are used to maintain, for the period of validity of the cookie concerned, the state information when a browser accesses different pages of a Website or when the browser later returns to that Website.
Only the issuer of a cookie can read or modify the information contained therein.
There are different kinds of cookies:

SWEET INN also draws the User's attention to the fact that, when the User opposes the installation or use of a cookie, a cookie refusal is installed on their terminal equipment.
However, if the refusal cookie is deleted, it will not be possible to identify the User as having refused the use of cookies.
Right of opposition and access:
The User has the right to object by the means described above.

Article 13: Intellectual Property

Except for content posted by Users, the brands, logos, slogans, graphics, photographs, animations, videos and texts found on the Website are the exclusive intellectual property of SWEET INN and may not be reproduced, used or represented without the prior express consent of SWEET INN under penalty of prosecution. Total or partial representation of the Website and its contents, by any means whatsoever, without the prior express consent of SWEET INN is prohibited and constitutes an infringement punishable by the ninth chapter of the Copyright Law, 5768-2007. The insertion of deep links to a page on the Website is prohibited without the prior written consent of SWEET INN. SWEET INN expressly forbids: the extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the contents of a database to another medium by any means and in any form whatsoever, and the reuse of all or a qualitatively or quantitatively substantial part of the database content.

Article 14: Enforceability of TOS

These TOS are binding upon registration of a Member on the Website. These TOS are binding throughout the operating life of the Website, and until new TOS replace the present.

Article 15: Modification of TOS

SWEET INN hereafter reserves the right to change the above TOS at any time. The changes will take effect 48 hours after publication. Users will be informed of TOS changes by consulting the date of last update of the TOS.

Article 16: Validity of TOS

The fact that one of the Parties did not require the application of any provision of these TOS, whether permanently or temporarily, shall under no circumstances be regarded as a waiver of such provisions. If any provision of these TOS were to be invalid under a legislative or regulatory provision in force and / or a court decision having force of res judicata, it will be deemed unwritten but will not affect the validity of the remaining provisions which shall remain fully applicable. In this case, the Parties will agree upon a new provision to replace the one declared null and irrelevant. It is stated that the new provision must resemble and comply as much as possible with the spirit and the economic impact on the Parties of the provision replaced.

Article 17: Governing Law and Jurisdiction

THESE TERMS ARE GOVERNED BY ISRAEL LAW FOR ANY DISPUTE, ONLY THE COURTS OF TEL AVIV WILL BE COMPETENT. This applies to substantive rules and procedural rules, notwithstanding the execution venues substantial or accessory obligations.
